All those files of a 1982 event are tagged with the {{PD-AR-Photo}} licence. As such, they are in public domain in Argentina since 2007, 25 years afterwards. However, they were still under copyright at the URAA date (1996, just 14 years later, see here), and as such they are still under copyright at the US. Thus, they should be deleted. The 30º anniversary of the war is in two months and there will be high interest in the topic, so this issue should be clarified beforehand.
Note that this deletion request is only for the images of the conflict using the PD-AR-Photo tag. Photos from the category but with other licences are not involved here. However, there are many suspicious "own works" around, but I will consider them in different DR if needed.
There was an earlier DR about this, Commons:Deletion requests/PD-AR-Photo de la Guerra de Malvinas. I declined it because the Spanish wikipedia began to discuss local uploads. However, the discussion ended shortly afterwards, and there was no further discussions since months ago. I asked for clarification, and I was told that they are not going to do it, for legal concerns. So, here we go: if the images will not be moved, they should be deleted. Delete all - According to Template talk:PD-AR-Photo#Template amended & some confussion / Plantilla modificada, y algunas confusiones, copyright protection extends to the later of 25 years from creation and 20 years from publication. So a photograph of a 1982 event was copyrighted at least until 1/1/2008, and possibly longer. Therefore all of these were definitely still copyrighted on the URAA restoration date of 1/1/1996, and gained US copyright until at least 1/1/2053 (known author who died in 1982). These can be uploaded at Wikilivres, since Canada uses the rule of the shorter term. cmadler (talk) 13:29, 18 July 2012 (UTC)
Keep These images are in the public domain in Argentina. Ferbr1 (talk) 13:32, 19 July 2012 (UTC)
- You have already asked for clarification in Commons:Café/Archivo/10#Commons:Deletion requests/PD-AR-Photo de la Guerra de Malvinas. And it was already explained that being in the public domain in Argentina now is not enough: they must be in the public domain in the US as well. And, because of the URAA, they are not. Someone once said "Why do you ask questions to which you already know the answers?". Deletion requests are not votes, "keep" votes that do not adress the copyright status in the US may be dismissed. Cambalachero (talk) 17:36, 19 July 2012 (UTC)
Keep This is a stupid situation, if the photos do not have rights that must prevail U.S. legislation? --Jorjum (talk) 09:53, 20 July 2012 (UTC)
Delete Unfortunately these images do not comply with Commons policies: they must be free in both United States and the country where the images were published first. Alpertron (talk) 13:57, 20 July 2012 (UTC)
Keep All these images are in public domain in the Argentine Repulblic, according to {{PD-AR-Photo}}. --Turkmenistan (talk) 23:48, 27 July 2012 (UTC)
- Please read my vote above, Alpertron (talk) 00:41, 30 July 2012 (UTC)
Keep Per common sense, nobody would claim the copyright of these pics in USA since their commercial value doesn't worth the effort.--DagosNavy (talk) 16:39, 4 August 2012 (UTC)
- Per the precautionary principle, that is not a valid argument. cmadler (talk) 16:54, 4 August 2012 (UTC)
Keep I suspect nearly all photographs of modern celebrities are copyrighted. There must be limits to the principle or Wikipedia will cease to function. Elryacko (talk) 18:55, 10 August 2012 (UTC)
- That suspicion is baseless, and a non-sequitur argument for this discussion Cambalachero (talk) 00:47, 3 September 2012 (UTC)
Keep PD in the source country is everythink what is needed. If not chance the commons rules, but don't delete major historic photos linke this! HBR (talk) 20:49, 2 September 2012 (UTC)
- Actually, the Licensing polcy requires that files are free both in the source country and the US. Cambalachero (talk) 00:47, 3 September 2012 (UTC)
- Per the precautionary principle, that is not a valid argument. cmadler (talk) 16:54, 4 August 2012 (UTC)
Deleted: Unclear copyright status. Unless we have clear, written/textual, tangible evidence indicating that these files are indeed freely licensed under a Commons compatible license, we cannot host them on Commons FASTILYs (TALK) 09:08, 12 September 2012 (UTC)
