Sorry, but this is obviously a recent and thereby copyrighted statue, which seems to be located in Lithuania. Regrettably, Lithuania has no freedom-of-panorama exemption from copyright. -- Túrelio (talk) 15:20, 22 September 2013 (UTC)[reply]

This allows a photographer to make and publish pictures of sculptures and works of architecture that are permanently located in public places (excluding works presented in museums and exhibitions), but they cannot be used commercially in any form. Hi Makshes, it does not matter that Wikipedia per se is not commercial, as per Commons' policy all uploads must be free for any kind of use, including commercial use. Dear Turelio, I am not a big specialist in all law's knowledge, I am only studing; may be it is possible to change just for this file license to a siutable, which forbid commercial use of this controversial file ? You need 1) to find out who is the sculptor. 2) if he is still living, you might try to contact him and explain him the problem. If he agrees to give a permission that this photo of his work is put under a free license, which would allow any kind of use, then you should prepare a valid permission text, send it to him, ask him to sign it and to sent it back to OTRS. If he is already dead, then it gets complicated as you need to obtain the permission from his heir(s). --Túrelio (talk) 09:02, 23 September 2013 (UTC)[reply]

That is not a problem. Even if the image would be deleted, any admin can un-delete with 2 clicks.
In order to prepare a valid permission, please see Commons:OTRS (also in other languages, but not in Lithuanian) and OTRS#Declaration of consent for all enquiries. You need to adapt the permission text a bit, as Mr. Kvintas is not the creator of the photo, but of the depicted sculpture. So, the permission must contain the statements 1) that he is the creator of the original sculpture "..." (official name of sculpture) and 2) that he does consent that this photo http://commons.wikimedia.org/wiki/File:Romain_Gary.jpg of his sculpture is released under a free license, which allows any kind (including derivative and commercial use) of the named photography. If Mr. Kvintas does not understand english, you might translate the english text into Lithuanian. If Mr. Kvintas is very old and does not use email, you could print the permission text on paper, send the paper to him and ask him to date it, sign and send it back to you.
