12 King’s Bench Walk, known as 12KBW, is a long-established civil set of chambers which has a well-deserved and consistent reputation for excellence in its core areas of practice, in particular personal injury and industrial disease. 12KBW barristers are at the forefront of developments in the law, having been instructed in many of the leading tort cases of recent times. We are professional and dedicated, whilst remaining approachable and friendly. Our barristers come from a range of backgrounds and we are proud of our record of recruitment based purely on merit. We are a large set, with over 90 barristers, including 14 silks, and our aim is to continue our expansion into the future. In contrast to many other civil sets, 12KBW is able to offer a service to clients, both claimants and defendants, from the smallest portal or small claims track case, to the most complex legal point in the Supreme Court or European Court of Justice. We cover civil and employment cases throughout England and Wales, employment cases in Scotland, and a range of cases in other jurisdictions. The depth and breadth of the expertise of our barristers, together with the ethos of working together in the interests of our clients, marks us out in the marketplace. Whilst we are all self-employed barristers, 12KBW has always prided itself on its cohesive and supportive culture. 12KBW is led by Steven Snowden KC, Head of Chambers, supported by our Management Committee. 12KBW’s Business Support Team, led by Oliver Parkhouse, Director of Clerking, provides clients and barristers alike with an efficient, proactive and effective service. A number of our barristers sit as judges, including Recorders and Deputy District Judges, act as arbitrators or are qualified mediators.

His core specialisms are personal injury, industrial disease, clinical negligence, inquests and inquiries, and associated insurance work. He is ranked as a Leading Junior for Personal Injury in the Legal 500. He represents both Claimants and Defendants in personal injury matters, mostly high value or complex evidential claims. Gareth frequently represents families, corporate interests or government agencies at Inquests. Gareth was appointed to the Attorney General's Panel of Counsel in 2020 on the Midlands Circuit. This small claims case has now been considered by 10 Judges across 4 tiers of appeal. The majority of the Supreme Court (4-1) accepted the arguments advocated on behalf of Mr and Mrs Lipton and ruled that airlines cannot rely on crew illness as an ‘extraordinary circumstance’ permitting them to avoid paying compensation to travellers who suffer consequential qualifying delay. The Supreme Court accepted that the pre-2023 Brexit legislation left no room for arguing that causes of action arising out of accrued (pre-Brexit) EU rights, had a separate life outwith the Brexit Legislation whereby such actions would still be made subject to Brussels Court rulings (past and future).     We have hand down on the SC Judgment Lipton v BA Cityflyer - the small claims case which has now been considered by 10 Judges across 3 tiers of appeal. The narrow ratio is that airlines cannot rely on crew illness as an ‘extraordinary circumstance’ permitting them to avoid paying compensation to travellers who suffer consequential qualifying delay. The wider obiter is really fascinating. It’s impossible to fairly summarise in a post what is a long and complex judgment but in headline, the majority of the SC accepted our arguments (4-1) that the pre 2023 Brexit legislation left no room for arguing that causes of action arising out of accrued (pre Brexit) EU rights, had a separate life outwith the Brexit Legislation whereby such actions would still be made subject to Brussels Court rulings (past and future). In short the majority considered that the UK’s Brexit legislation amounted to a complete code of translation between EU sourced law and the UK domestic legislative sphere. In even shorter measure, the construed intention of the Acts was that a clean joinder from Europe was intended and should therefor be given effect. This is a legal and not a political Judgment. I am immensely grateful to my juniors Max Archer, Daniel Isenberg and Corinne Novell - being a mere mouthpiece for my juniors was never more easy nor more satisfying.
