Attention RNs, LPNs, and nurse aides working with private care agencies! Are you being denied overtime, medical benefits, liability insurance, and workers' compensation coverage? Don't be fooled by agencies misclassifying you as independent contractors/1099. It's important to verify that you're working with a reputable agency. Adjusters and case managers, please make sure the provider on any file is using only W-2 employees. To ensure correct classification, call the USDOL wage & hour division at 1-866-487-9243. Tell them your job description and that you're supervised by a physician's plan of care and the agency supervisor. They will tell you if you are classified correctly or not by the agency. If you're not classified correctly, there are no consequences to you. You may even be entitled to overtime you've worked but was not paid by the agency due to the agency incorrectly misclassifying you as an independent contractor for the prior three (3) years.
