He shares why the H-1B is a solution for Registered Nurses (RNs) due to chronic shortages and the retrogression of EB-3 visa priority dates. Degree Requirement Change: The U.S. Department of Labor now classifies RNs as requiring a Bachelor’s degree, opening up more H-1B visa opportunities, especially for not-for-profit healthcare employers exempt from the annual cap. Proving Bachelor’s Degree Necessity: The challenge lies in demonstrating that the RN position requires a Bachelor’s degree, despite many health systems employing Associate’s degree-prepared RNs2. Increase in Approvals: There has been a significant rise in approved H-1B petitions for RNs, indicating a shift in immigration strategies to address the growing RN workforce gap.
