Reform of Australian privacy law is finally moving, with the Australian Government committing to complete legislative reform during 2024. Of 116 proposals included within the Attorney General's 'Review of the Privacy Act', the Government has agreed with 38 and committed to further consultation on a further 68. Reform will focus on: (1) bringing the Privacy Act into the digital age; (2) uplifting protections; (3) increasing clarity and simplicity for entities and individuals; (4) improving control and transparency for individuals over their personal information; and (5) strengthen enforcement.

Super interesting to read the government's response to the Privacy Act Review. The wheels of privacy law reform are turning (slowly). In particular, it looks like there will be changes (following further consultation) to the small business exemption and the employee records exemption. In addition, the government agrees in principle to changes to the notifiable data breach regime (including a 72-hour notification requirement), increased protection of children and requirements for non-government entities to conduct privacy impact assessments for high-risk activities. These reforms will likely be implemented in stages with proposals agreed in principle by the government being subject to further engagement and review before implementation.

A culture of continued review and reform will keep pace with new and emerging expectations to privacy. People first. Right to privacy must not only be enshrined but a culture developed that accepts privacy is a right. If we don't need the data, don't collect and store it and you lose it, there must be a consequence to breaching trust. People first. A culture that is vigilant to the diminution of personal right must be created. Louder.
