On June 24, a U.S. District Court enjoined subsidiaries of Foxconn from pursuing arbitration in China against Vicor. The Foxconn subsidiaries had attempted to have arbitrators in China rule that their purchase orders for Vicor modules entitled them to royalty-free licenses to Vicor patents, including patents asserted in a pending investigation by the United States International Trade Commission (“ITC”). An ITC exclusion order could bar Foxconn from importing infringing power modules and systems containing such modules, including AI accelerators, TPUs, GPUs and CPUs. https://ow.ly/vUhH50SqWvX

Citing errors in determining a reasonable royalty rate, the Federal Circuit has vacated a $2.2 billion jury verdict against Intel for infringing two VLSI patents related to semiconductor technology. The court also vacated the jury’s determination that Intel infringed one of the patents (titled “System and method of managing clock speed in an electronic device”), although it affirmed the verdict of infringement with respect to the other patent-in-suit (titled “Minimum memory operating voltage technique”). The damages calculation for the infringed patent needed to be redone, the court said, because VLSI’s expert witness “made a readily identifiable error” in calculating the power-savings benefit attributable to the accused Intel processor from use of the infringing functionality. Micron Technology hit with $445M Netlist damages award 🤯💡 #SSD and #memory module supplier #Netlist has won a memory module patent infringement legal case against #Micron with the jury awarding it $445 million in damages. The case, 2:22-cv-00294, was heard in the district court for the Marshall Division in the Eastern district of #Texas. Two patents were involved, the ‘417, where the jury awarded Netlist $20 million, and the ‘912 patent with a $425 million damages award. The jury further found that Micron wilfully infringed the ‘912 and ‘417 patents. Such wilful infringement means the court may increase the damages by up to three times, to $1.34 billion. Netlist has steadfastly defended its patents by variously suing Diablo Technology, Google, Micron Technology, Samsung Electronics and SK hynix for #patent infringement and breaking licensing or development deal conditions. I would like to introduce my experience about patent licensing. I invented the DVFS (Dynamic Voltage and Frequency Scaling) and the Thermal Throttling technologies which are US 6,792,379 and US 6,957,163 patents. See below. These will be essential technologies for present LSI like CPU, GPU or AI-chip. I proposed many companies with the claim chart of their products to enter negotiation. But US company’s response were no interest and Taiwan’s was no response. Only China’s responded. I don’t have enough assets. These patents were expired without entering discussion or licensing. I expect to improve this situation, at least to enter discussion.

I invented the DVFS (Dynamic Voltage and Frequency Scaling) and the Thermal Throttling technologies which are US 6,792,379 and US 6,957,163 patents. See below. These are essential key technologies for present LSI devices like CPU, GPU, or AI-chip. I sent letters and mail to some companies with claim charts of their products to enter licensing negotiation. The response from IBM, Intel, and AMD were “ no interest ” and TSMC was no response. Next step will be lawsuit. But I don’t have enough assets. These patents were expired without validity discussions or licensing. I expect to improve this situation.

The IQ Battle of Memory 💾 Intel (I) and Qualcomm (Q) were in a 5 year long battle for a chipset patent (US8838949) infringement. Last year it came to an end with Intel succeeding in invalidating Qualcomm’s patent. 💾The case was hanging around the claim construction of some elements in the independent and dependent claims. The most crucial one was the term “hardware buffer” in claims 1, 2 and 8. 💾 Once again the interpretation of the term was key in deciding if the patent was valid or not. The ‘262 patent relates to a wireless OFDM network that transmits and receives first and second packets each having header bits and utilizing variable header repetition. (UCT) has filed its first litigation, over patents from a portfolio received from Lattice Semiconductor in November 2021. The plaintiff accuses HP (1:23-cv-01177) and Lenovo (2:23-cv-00449) of infringing the same eight patents via alleged support for various standards associated with DisplayPort and USB (e.g., USB 3.0, 4.0, and -C) by a wide array of devices, including adapters, computers, docking stations, laptops, and/or monitors.
