This file was initially tagged by Mysterymanblue as Copyvio (copyvio) and the most recent rationale was: Per Commons:Hirtle chart#Sound recordings, essentially all sound recordings published 1923–1971 are still copyrighted. For works published during this period, failure to include a copyright notice or to renew the copyright did not cause the copyright to expire. This work is almost certainly a copyright violation. Support deletion. When I uploaded this file in 2020, I was unaware at the time that the 2018 CLASSICS Act had extended copyright protection on songs. I was going off my knowledge of copyright lengths from a college class in 2016. Prior to the passage of the CLASSICS Act, this song would have been in the public domain. I apologize for my mistake. Deleted: Music may be protected by more than one copyright (most commonly separate copyrights may exist for the musical composition and sound recording). In this case, this particular recording of Down Hearted Blues by Bessie Smith (1894–1937) appears to have been recorded and published in 1923 in the US by Columbia Records. The US copyright to the 1922 musical composition by Love Austin (1887–1972) and Alberta Hunter (1895–1984) has expired. However, the US term of protection for a sound recording published in 1923 expires 100 years after publication (see specifically 17 USC § 1401 (a)(2)(B)(ii)).
