These are all photographs of paintings by Robert McCall (1919-2010), who was never an employee of NASA. While the photographs of his works in this list were taken by NASA and are therefore PD, the works themselves need a license from McCall's heirs.

Yes, Bob McCall with wife.jpg and Robert McCall painting.jpg are qualified as de minimis. The painter (and wife) are the main subjects for these pictures. The paintings are "accessories". --Ras67 (talk) 14:15, 3 February 2017 (UTC)[reply]

 Keep These paintings are commissioned work for NASA and therefore property of the agency. You have forget to make a DR for this files:

Regarding your opinion "commissioned work" is not existent and we have no permission of McCall's heirs. If your opinion is assessed as truth where is the next instance to appeal? Otherwise we have to delete all images from NASA missions with multinational crews. NASA often don't say, who made a photo and alone the possibility that it comes from a Roskosmos/JAXA/ESA/CSA crew member oblige us to delete all. --Ras67 (talk) 14:15, 3 February 2017 (UTC)[reply]

First, the two images which Ras67 claims are de minimis are clearly not. The test of DM is whether an average viewer would notice it if the object in question were removed from the image. Since the copyrighted works are the only thing visible other than the person(s), they are clearly not DM.
As for the second list, I agree that at least some of those should also be deleted. As noted in the DR name, these are only the images in Category:Robert McCall.
It is completely clear that the fact that NASA commissioned these is irrelevant. The best example of this problem is at Category:Official presidential painted portraits in the White House where portraits of five presidents cannot be included because of copyright. And, although there is no evidence that the copyright for these was transferred to the government, even if it were, the works would still not be PD -- an example of that is the obverse of the Sacagawea dollar. .     Jim . . . .
